Hey,

I have ordered the xyz sensors and the ardu shield kit from diy drones. the stuff is with a relative of mine in USA. I wish to know weather or not the US Customs will object on sending the stuff to me in Pakistan as my relative will courier the stuff to my address in Pakistan.

Secondly if he sends it to another address in Canada, will the Canadian Customs object on the sensors and shield kit?

  • I believe the sensors employed on the Shield are controlled under the Export Administration Regulations (EAR). I am guessing that you will have to apply for an export permit. However, I may be wrong. It really all depends on what is being exported, where it is being exported to, and for what use. So, because we are dealing with sensors for autopilots and, as you pointed out the US-Pakistan relationship is different than the US-Canada relationship, that's why I am guessing you will have to apply for a permit.

    Now, it is my understanding - which may be wrong so take it for what its worth - that if you are required to have an export permit, then yes the US will object if you relative sends it to you. If your relative sends it to you anyways without a permit, then the people who exported the sensors are legally liable and subject to criminal penalties. Now, if your relative in the US signed a document or agreed to some terms and conditions, from DIY Drones store, saying that they were not going to export the purchased hardware and that DIY Drones absolves themselves from all responsibility, then your relative will solely be legally liable. However, if they never had to agree to such terms and conditions or signed any document regarding exports provided by DIY Drones, then DIY drones is legally liable. However, if DIY drones never agreed to some terms and conditions of sale absolving their sensor supplier from any export liability, then the their sensor supplier is liable; and so on.

    If you have to apply for an export permit, then sending it to Canada will not help. Canada may not object but, if the person in Canada reexports it to you as a means to bypass the permit process, then the people involved in the export are legally liable and subject to criminal penalties again. The difference now is that Canada is involved.

    In conclusion, Chris should be able to tell you if you need an export permit.
