Patrick McKay commented on Patrick McKay's blog post Remote ID Proposal Outlaws Home-built RC Aircraft
"Like I figured, the AMA completely missed the most important part of the proposed rule that affects them the most. Because the AMA's government relations people are absolute idiots who know nothing about statutory interpretation, and just see what…"

I want to clear up a myth about the FAA's proposed remote ID rules that I've been seeing floating around. People think that amateur home-built model aircraft will be largely unaffected by this, since they can just fly at AMA fields. Or people think…

Patrick McKay commented on Krzysztof Bosak's blog post Comments, debunking and alternative proposal for Amazon's revision for airspace model.
"No, it's a 53 page PDF of a white paper criticizing the Amazon airspace proposal (and griping about how much people who write patent applications are paid). It looks quite thorough, though I don't have time to actually read something that long."

Patrick McKay commented on Fly4Me's blog post Fly4.me drone video compeition
"So I'm curious what you consider to be FAA regulations, considering there are very few actual regulations applicable to UAS at this point (currently just registration and FAR 91.13 prohibiting careless and reckless operation), but a lot of different…"

Patrick McKay commented on Patrick McKay's blog post FOIA Request Reveals FAA UAS Enforcement Data
"Michael, not sure I understand your question. The PDF documents linked above are scans of the paper documents the FAA sent me. It's not just one sentence, though the individual entries in the list are rather short on paragraph breaks. Try…"

Back in April I filed a FOIA request with the FAA requesting the following documents:“All releasable records related to civil enforcement actions or certificate actions against operators of unmanned aerial systems (UAS) or model aircraft, initiated…

Patrick McKay commented on Patrick McKay's blog post Draft Legislation Would Ban All RC Aircraft in Colorado
"So I noticed the bill has now been officially introduced as SB15-059: http://www.leg.state.co.us/clics/clics2015a/csl.nsf/fsbillcont2/CF1...

The official text is available here:…"

"Here's the latest from Vic Moss of Colorado Aerial Media Pros:

Here's the latest.

We're good with the UAV's, so we don't need anymore.

So far, the following organization and/or gov't agencies are on record as opposing this legislation: AMA,…"

I have recently learned of a piece of draft legislation soon to be introduced in the Colorado State Senate by Senators Linda Newell and Kevin Lundberg (who I interned for in high school ironically), which if passed as worded would effectively ban…

Patrick McKay commented on Chris Anderson's blog post Commercial drones are legal in the US, court rules [UPDATE: FAA appeals]
"The FAA trumpets about their appeal staying the decision, but a stay is completely meaningless here. This isn't like the gay-marriage battle in California, where first there was a clear law prohibiting it, then a court ruled that law was…"

Patrick McKay commented on Chris Anderson's blog post Commercial drones are legal in the US, court rules [UPDATE: FAA appeals]
"Now that the FAA is appealing (which will take months, and we probably won't see a final decision by the NTSB Board until the end of the year, when the NPRM is supposedly due), I doubt they will take any further action like trying to make an…"

Patrick McKay commented on AKRCGUY's blog post We are tired of people saying “DRONES ARE ILLEGAL!” Here is real talk on what the law really is or isn’t
"The ruling just came down in Trappy's case: http://www.kramerlevin.com/files/upload/PirkerDecision.pdf
Case dismissed.
Ruling: The FAA has no jurisdiction over model aircraft, regardless of whether they are flown commercially or not. Peter Sachs is…"

Patrick McKay commented on Patrick McKay's blog post FOIA Response Reveals FAA Routinely Misrepresents the Law Regarding Unmanned Aircraft
"John,
Lawsuits are pretty much the only opportunity us regular folks will have to influence UAS integration until the NPRM comment period. You want to "become part of the process"? Then become a billionaire CEO of a Fortune 500 defense contractor,…"

Patrick McKay commented on Patrick McKay's blog post FOIA Response Reveals FAA Routinely Misrepresents the Law Regarding Unmanned Aircraft
"John - It is very important to be challenging the FAA's authority at this stage. Every indication is that the UAS rule, when it is published, will be incredibly restrictive and will basically make commercial use of small UAS' impossibly expensive…"

Patrick McKay commented on Patrick McKay's blog post FOIA Response Reveals FAA Routinely Misrepresents the Law Regarding Unmanned Aircraft
"John, not true. Court precedents under the Administrative Procedures Act show that a federal agency cannot suddenly completely reverse course on its entire regulatory approach in a particular area without engaging in formal rule making. For decades…"
